No fiscal implication to the State is anticipated.

The bill would amend Chapter 36, Water Code, to establish procedures related to an investigation and a hearing conducted by a groundwater conservation district in response to a complaint or suit by an owner of a well regarding another person operating or drilling wells without a permit or in other violation of district rules. The provisions of the bill would apply only to a violation that occurs on or after the effective date of the bill.

The bill would take effect immediately if it were to receive the required two-thirds vote in each house; otherwise, it would take effect September 1, 2007.
