No fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to authorize an occupant of a structure to bring a civil action in the justice court in the precinct where the structure is located to enforce an ordinance relating to health and safety conditions of the occupant. Under current statute, enforcement actions under Chapter 54 are only authorized for a municipality, and only in a district or county court at law.

The bill would take effect September 1, 2007.


Local Government Impact

The impact on the courts as a result of provisions in the bill is not anticipated to have a significant fiscal impact on units of local government.
