No fiscal implication to the State is anticipated.

The bill would amend Subchapter I of Chapter 16, Water Code, to authorize a political subdivision to impose an unspecified penalty on landowners who violate the subchapter or rules adopted or orders issued under the subchapter.

The subchapter would also be amended to change the level of stringency a political subdivision may impose when adopting enforcement provisions related to land use and control measures. Under current statute, the provisions must be consistent with those of the National Flood Insurance Act (NFIA) or the Federal Emergency Management Agency (FEMA), as applicable. Proposed in the bill would be enforcement provisions that are not less stringent than those established by NFIA or FEMA.

The bill would take effect September 1, 2007.
