No significant fiscal implication to the State is anticipated.
The bill would allow preconstruction permits submitted to the Texas Commission on Environmental Quality (TCEQ) to be renewed if an amendment application, which requires public notice, is filed within years of the scheduled permit renewal, which is required every 10 years after initial permit issuance. The bill also proposes to authorize the TCEQ, for cause, to establish a permit term for a preconstruction permit issued for an air pollution source that is not subject to permitting requirements of Title IV or V of the Federal Clean Air Act for a period not to exceed 10 years. The bill would provide flexibility to the TCEQ and to permit applicants, which could result in greater efficiency. Any savings resulting from the bill, however, is not expected to be signficant.
