No fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to stipulate that certain municipalities in which any of the municipality's incorporated territory is located within 15 miles of a toll project owned and operated by the Texas Department of Transportation (TxDOT) would continue to have authority to annex an area for limited purposes if TxDOT were to transfer ownership or operation of the toll project. Current statute makes this provision applicable only to home-rule cities with a population of more than 225,000.

The bill would take effect immediately if it were to receive the required two-thirds vote in each house; otherwise, it would take effect September 1, 2007.

The criteria for which municipality would be affected applies only to the City of Austin.


Local Government Impact

Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
