The bill would amend the Government Code by extending the Texas Sunset Act date for the Adjutant General’s Department from September 1, 2009 to September 1, 2015. The bill also abolishes the Texas Military Facilities Commission (TMFC) and transfers its duties, functions, and personnel (FTEs) to the Adjutant General's Department (AGD). The bill transfers the responsibility for acquiring, constructing, repairing and maintaining armories and other military facilities from TMFC to the AGD and provides that the Adjutant General is the exclusive authority for construction, repair, and maintenance of state military forces armories, facilities, and improvements owned by the state and located on the Department's property. The AGD would also have exclusive authority to dispose of surplus property and to request the Texas Public Finance Authority (TPFA) to issue bonds. The bill would also amend the Government Code relating to the AGD borrowing money and issuing and selling bonds. The AGD may request bonds to acquire building sites or buildings or to construct, remodel, repair, or equip one or more buildings.
According to the TPFA, additional administrative work should not be significant and implementation of the bill would be absorbed with current resources. The Adjutant General’s Department has determined that the costs associated with implementing the bill are not anticipated to be significant.
