No significant fiscal implication to the State is anticipated.

The bill would require that a person (installer or third-party trainer) must be approved by the Texas Commission on Environmental Quality (TCEQ) to provide maintenance training for owners of on-site sewage disposal systems that use aerobic treatment. The bill would establish basic training, employment, and approval requirements for the trainers, and it would eliminate the necessity for manufacturers to train homeowners.

Although the bill does not authorize the collection of fees or establish new fees, this estimate assumes that the TCEQ has statutory authority through Water Code, Capter 37, to collect necessary fees for the agency to administer the licensing, registration, and training approval programs. Assuming a cost of $150 per trainer, and 500 persons applying for training certifications in each of the first two years of the program, this estimate assumes the TCEQ would incur costs of $75,000 per fiscal year. Because this estimate assumes that the agency would recover such costs through fees assessed on those applying for training certificates, the net fiscal impact of the bill is expected to be zero. This estimate assumes that fees collected would be deposited to and costs would be paid out of the General Revenue-Dedicated Occupational Licensing Account No. 468
