No fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code to authorize the county commissioners court in a county bordering both on the shoreline of Galveston Bay or its tidewater limits to grant an exclusive franchise for solid waste collection and transportation services within the unincorporated areas of the county, to offer those services, to mandate the use of the service, to charge fees for the service, and to establish the service as a separate utility.

The bill would take effect immediately if it were to receive the required two-thirds vote in each house; otherwise, it would take effect September 1, 2007.


Local Government Impact

Because a county would be allowed to charge and collect fees related to the services, no significant fiscal implication to units of local government is anticipated.
