LEGISLATIVE BUDGET BOARD
Austin, Texas

CRIMINAL JUSTICE IMPACT STATEMENT

80TH LEGISLATIVE REGULAR SESSION

March 29, 2007

TO:
Honorable Joe Driver, Chair, House Committee on Law Enforcement

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB489 by Berman (Relating to the duty of a passenger involved in certain accidents to render aid; providing a criminal penalty.), As Introduced

The bill would amend the Transportation Code by making the failure of rendering aid under certain circumstances punishable by imprisonment in the institutional division of the Texas Department of Criminal Justice (TDCJ) for not more than five years or confinement in the county jail for not more than one year; a fine not to exceed $5,000; or both the fine and the imprisonment or confinement.

It is assumed that the number of persons convicted under this statute would not result in a significant impact on the programs and workload of state corrections agencies or on the demand for resources and services of those agencies.
