CRIMINAL JUSTICE IMPACT STATEMENT

80TH LEGISLATIVE REGULAR SESSION

March 17, 2007

TO:
Honorable Jerry Madden, Chair, House Committee on Corrections

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB927 by Haggerty (Relating to a court's jurisdiction to suspend the sentence imposed for a felony and place the defendant on community supervision.), As Introduced

The bill would amend the Code of Criminal Procedure by extending the period a court has jurisdiction over a defendant sentenced to the institutional division from 180 days to two years.  During this period the court can suspend certain eligible defendants’ sentences and impose community supervision.  In fiscal year 2006, 632 offenders were released from prison to community supervision.  Depending on the application of the provision of the bill it is possible the number of offenders released from prison to community supervision would increase, resulting in possibly lower correctional populations.  However, it is not expected to have a significant impact on criminal justice populations.
