TO: | Honorable Joe Driver, Chair, House Committee on Law Enforcement |
FROM: | John S. O'Brien, Director, Legislative Budget Board |
IN RE: | HB2112 by Patrick (Relating to banning handguns and certain other weapons from parking areas associated with schools or educational institutions; providing criminal penalties.), As Introduced |
The bill would amend the offense of places weapons prohibited by adding any real property that is owned or leased by a public or private school or educational institution and routinely used by the faculty staff, students, or visitors of the school or educational institution, including a parking lot, parking garage or other parking area, to the places where a person cannot possess a prohibited weapon. The offense of places weapons prohibited is punishable as a third degree felony.
A third degree felony is punishable by imprisonment in the institutional division for any term of not more than 10 years or less than 2 years, or in addition to confinement, a fine not to exceed $10,000.
For this analysis it is assumed that the number of additional offenders convicted under this statute would not result in a significant impact on the programs and workload of state corrections agencies or on the demand for resources and services of those agencies.
