HB2316 by Truitt (Relating to the licensing and regulation of wholesale distributors of prescription drugs; providing penalties.), As Introduced

The provision of the bill that is the subject of this analysis would amend the Health and Safety Code by making the wholesale distribution of prescription drugs in violation of the Health and Safety Code a felony punishable by imprisonment for a term not to exceed 15  years, a fine not to exceed $50,000, or both imprisonment and a  fine.  If it is shown on the trial of an offense under this section that the person knowingly engaged in the wholesale distribution of prescription drugs in violation of the subchapter, the offense is a felony punishable by imprisonment for a term of not more than 99 years or less than 15 years, a fine not to exceed $500,000, or both imprisonment and a fine.

For this analysis it is assumed that the number of offenders convicted under this statute would not result in a significant impact on the programs and workload of state corrections agencies or on the demand for resources and services of those agencies.
