HB3310 by Jackson, Jim (Relating to fraud investigations and criminal offenses involving the Medicaid program; providing criminal penalties.), As Introduced

The bill would amend the Penal Code by making the offense of securing execution of document by deception punishable by the next higher category of offense if the offense involves the state Medicaid program.  Punishment for the offense of securing execution of document by deception ranges from a Class C misdemeanor to a felony of the first degree depending on the value of the property involved.  The bill would also amend the Medicaid Fraud provision of the Penal Code to further define the conditions which constitute monetary in-kind benefits.   The bill would also make other conforming changes to the Penal Code and the Code of Criminal Procedure.  The bill is not expected to have a significant impact on criminal justice populations.
