OPEN GOVERNMENT IMPACT STATEMENT

80TH LEGISLATIVE REGULAR SESSION

April 2, 2007

TO:
Honorable Robert Duncan, Chair, Senate Committee on State Affairs

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB889 by Wentworth (Relating to the charges for certain public information maintained by a governmental body.), Committee Report 1st House, Substituted

As a result of this bill there will be a restriction upon:

(1) the open records law;
(2) the access to government information.

The bill would amend the Government Code by allowing a governmental body to charge a requestor, who has been provided at least 50 pages of responsive paper records in the same calendar month, for any subsequent request for one or more pages of public information. The bill would allow this charge for any subsequent request to be extended to a requestor who has had at least 50 pages of responsive paper records made available for inspection in a single calendar month.
