Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Business & Commerce was held on Tuesday, April 17, 2007, in the Betty King Committee Hearing Room, 2E.20, at Austin, Texas.

The chair called the meeting to order at 9:00 a.m. 

 

The chair laid out SB 1365 and recognized the author, Senator Williams, to explain the bill. 

Senator Watson sent up a committee substitute; the chair recognized Senator Williams to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Fraser moved that SB 1365 be left pending to await a quorum; without objection, it was so ordered.  Upon arrival of a quorum,

Senator Harris moved adoption of the committee substitute.  Without objection, it was so ordered.  Senator Harris moved that SB 1365 do not pass but that CSSB 1365 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Harris moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out SB 753, SB 856, SB 857, and SB 858 together, and recognized the author, Senator Shapleigh, to explain the bills. 

 

At 9:08 a.m. the roll was called, and quorum was present.

 

Senator Lucio, Jr. sent up a committee substitute to SB 753; the chair recognized Senator Shapleigh to explain the difference between the committee substitute and the senate bill as filed.

Senator Van de Putte moved adoption of the committee substitute; without objection, it was so ordered.  Senator Van de Putte moved that SB 1009 do not pass but that CSSB 1009 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent. 

 

The chair laid out the subcommittee report on SB 1523.  Senator Janek was recognized to explain the subcommittee report on CSSB 1523, adopted in subcommittee.  Senator Fraser moved that CSSB 1523 be left pending to await a quorum; without objection, it was so ordered.  Upon arrival of a quorum, Senator Janek moved that CSSB 1523 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Janek moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out the subcommittee report on SB 1736.  Senator Janek was recognized to explain the subcommittee report on CSSB 1736, adopted in subcommittee.  Senator Fraser moved that CSSB 1736 be left pending to await a quorum; without objection, it was so ordered.  Upon arrival of a quorum, Senator Janek moved that CSSB 1736 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Janek moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

the subcommittee report on CSSB 637, adopted in subcommittee.  Senator Fraser stated that public testimony would not be reopened considering it had already been heard in subcommittee.  However, a witness registered on the bill, and is shown on the attached list.  Senator Fraser moved that CSSB 637 be left pending to await a quorum; without objection, it was so ordered.  Upon arrival of a quorum, Senator Van de Putte moved that CSSB 637 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Van de Putte moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out the subcommittee report on 486.  Senator Janek was recognized to explain the subcommittee report on CSSB 486, adopted in subcommittee.  Senator Janek sent up a new substitute in lieu of the adopted subcommittee report and explained the new substitute.  Senator Fraser moved that SB 486 be left pending to await a quorum; without objection, it was so ordered.  Upon arrival of a quorum, Senator Janek moved adoption of the new committee substitute.  Without objection, it was so ordered.  Senator Janek moved that SB 486 do not pass but that CSSB 486 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Janek moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.
