Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Subcommittee on Emerging Technologies and Economic Development was held on Wednesday, May 9, 2007, in the Betty King Committee Hearing Room, 2E.20, at Austin, Texas.

The chair called the meeting to order at 8:13 a.m.  Senator Harris assumed the chair.  The chair laid out HB 1196 and recognized the Senate sponsor, Senator Janek, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair moved that HB 1196 be left pending; without objection, it was so ordered. 

 

The chair laid out HB 2092 and recognized the Senate sponsor, Senator Shapiro, to explain the bill.  Public testimony was opened and no witnesses came forward to testify.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Janek resumed the chair and moved that HB 2092 be left pending; without objection, it was so ordered. 

 

Senator Harris assumed the chair and laid out HB 1188 and recognized the Senate sponsor, Senator Shapiro, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Janek resumed the chair and moved that HB 1188 be left pending; without objection, it was so ordered.  

 

The chair laid out HB 2308 and recognized the Senate sponsor, Senator Hegar, to explain the bill.  Senator Janek sent up a committee substitute; the chair recognized Senator Hegar to explain the difference between the committee substitute and the house bill as engrossed.   Public testimony was opened and no witnesses came forward to testify.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair moved that HB 2308 be left pending; without objection, it was so ordered. 

 

The chair laid out HB 3440 and recognized the Senate sponsor, Senator Harris, to explain the bill.  Senator Harris sent up a committee substitute; the chair recognized  Senator Harris to explain the difference between the committee substitute and the house bill as engrossed.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Janek moved that HB 3440 be left pending; without objection, it was so ordered. 

 

The roll was called at 8:36 a.m. and a quorum was established.  Senator Harris assumed the chair.  The chair laid out HB 3694 and recognized the Senate sponsor, Senator Janek, to explain the bill.  Senator Janek sent up a committee substitute; the chair recognized Senator Janek to explain the difference between the committee substitute and the house bill as engrossed.  Public testimony was opened and no witnesses came forward to testify.  The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Janek requested that the committee substitute not be adopted, and Senator Janek sent up Committee Amendment 1.  Public testimony was reopened and witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Janek requested unanimous consent to incorporate the amendment into the committee substitute; without objection, it was so ordered.  Senator Janek then moved that the new committee substitute be adopted; without objection, it was so ordered.  Senator Janek moved that HB 3694 do not pass but that CSHB 3694 be reported back to the full Senate committee on Business & Commerce with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

Senator Janek resumed the chair, laid out SB 1774 and recognized Senator Watson, in the absence of the author, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Janek moved that SB 1774 be left pending; without objection, it was so ordered. 

 

The chair called up HB 2308 from pending business.  Senator Harris moved that the committee substitute be adopted; without objection it was so ordered.  Senator Harris moved that HB 2308 do not pass but that CSHB 2308 be reported back to the full Senate committee on Business & Commerce with the recommendation that it do pass and be printed.  The motion carried with a record vote of 4 ayes, 1 nay, 0 present not voting, and 0 absent.

 

The chair called up HB 2092 from pending business and Senator Harris moved that HB 2092 be reported favorably to the full Senate committee on Business & Commerce with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

Senator Watson assumed the chair and called up HB 1196 from pending business.  Senator Janek moved that HB 1196 be reported favorably to the full Senate committee on Business & Commerce with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

The chair called up HB 1188 from pending business and Senator Janek moved that HB 1188 be reported favorably to the full Senate committee on Business & Commerce with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

Senator Janek resumed the chair and called up HB 3440 from pending business.  Senator Estes moved that the committee substitute be adopted; without objection it was so ordered.  Senator Harris moved that HB 3440 do not pass but that CSHB 3440 be reported back to the full Senate committee on Business & Commerce with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

The chair called up SB 1774 from pending business and public testimony was reopened.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Janek moved that SB 1774 be left pending; without objection, it was so ordered. 

 

The chairman read Motions in Writing requesting unanimous consent to be shown voting aye on the following:  Senator Harris on HB 1196 and HB 1188.

 

There was no action taken for the following bill(s): SB 1979.
