Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Education was held on Tuesday, February 27, 2007, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 8:35 a.m.  The following business was transacted: 

 

At 8:35 a.m. Senator Janek assumed the chair.  Senator Janek declared that the Committee was returning from recess and that a quorum had been established at the previous hearing.

 

The chair laid out SB 82 and recognized the author, Senator Van de Putte, to explain the bill. 

 

Senator Van de Putte sent up a committee substitute; the chair recognized Senator Van de Putte to explain the difference between the committee substitute and the senate bill as filed. 

 

Senator Van de Putte sent up Committee Amendment 1.

 

Senator Van de Putte sent up Committee Amendment 2.

 

Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Patrick moved adoption of the committee substitute; without objection, it was so ordered. 

 

Senator Van de Putte moved adoption of Committee Amendment 1; without objection, the amendment was adopted. 

 

Senator Van de Putte moved adoption of Committee Amendment 2; without objection, the amendment was adopted. 

 

Senator Van de Putte requested unanimous consent to incorporate amendments into the committee substitute; without objection, it was so ordered.  Senator Van de Putte moved that the new committee substitute be adopted; without objection, it was so ordered.  Senator Patrick moved that SB 82 do not pass but that CSSB 82 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent. 

 

The chair laid out SB 7 and recognized the author, Senator Hinojosa, to explain the bill. 

 

Senator Janek sent up a committee substitute; the chair recognized Senator Hinojosa to explain the difference between the committee substitute and the senate bill as filed.

Senator Shapiro moved that SB 25 be left pending to await a quorum; without objection, it was so ordered.

Senator Van de Putte moved that SB 370 do not pass but that CSSB 370 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent. 

 

Senator Shapiro moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out SB 389 and recognized the author, Senator Shapiro, to explain the bill. 

 

Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Williams moved that SB 389 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 1 present not voting, and 2 absent. 

 

Senator Shapiro moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

Senator Shapiro moved adoption of the minutes from the previous hearing held on February 20, 2007; without objection, it was so ordered.

 

Senator Janek moved adoption of the committee substitute to SB 7; without objection, it was so ordered.    

 

Senator Janek sent up Committee Amendment 1 to CSSB 7 and moved adoption; without objection, the amendment was adopted.

Senator West requested unanimous consent to be shown voting aye on CSSB 7and CSSB 82, and present not voting on SB 389; there being no objection, it was so ordered.

 

Senator West requested unanimous consent to be shown voting aye on on CSSB 370; there being no objection, it was so ordered.

 

At 2:06 p.m. Senator West assumed the chair.

Senator Janek withdrew Committee Amendment 4.  Senator Janek sent up Committee Amendment 4a.  Senator Janek was recognized to explain the amendment.  Senator Janek moved adoption; without objection, the amendment was adopted. 

 

Senator Shapiro sent up Committee Amendment 6 and moved adoption; without objection, the amendment was adopted. 

 

Senator Shapiro requested unanimous consent to withdraw previously adopted Committee Amendment 2.  Senator Shapiro sent up Committee Amendment 7.  The Chair left Amendment 7 pending.

 

Senator Zaffirini sent up Committee Amendment 8. The Chair left Amendment 8 pending.
