Pursuant to suspension of Senate Rule 11.18, a public hearing of the Senate Committee on Education was held on Wednesday, March 28, 2007, at Senator Shapiro's Desk on the Senate Floor.

The chair called the meeting to order at 12:15 p.m. There being a quorum present, the following business was transacted:
The clerk called the roll.
The chair laid out the subcommittee report on SB 161. Senator Janek then moved adoption of the subcommittee report; there being no objection, it was so ordered. Senator Ogden sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted. Senator Ogden moved that SB 161, as amended, be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent. Senator Ogden moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. Senator Van de Putte moved to reconsider the vote by which SB 161, as amended, was reported back to the Senate with the recommendation that it do pass and be printed. There being no objection, the bill was before the committee. Senator Van de Putte requested unanimous consent to roll the amendment into a committee substitute; without objection, it was so ordered. Senator Van de Putte moved adoption of the new committee substitute; without objection, it was so ordered. Senator Van de Putte moved that SB 161 do not pass but that CSSB 161 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent. Senator Van de Putte moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

Senator Zaffirini then moved that the committee substitute be adopted; without objection, it was so ordered. Senator Zaffirini moved that SB 273 do not pass but that CSSB 273 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.
At 12:30 p.m. Senator Averitt assumed the chair.
The chair laid out the subcommittee report on SB 285. Senator Shapiro then moved adoption of the subcommittee report; there being no objection, it was so ordered. Senator Shapiro moved that SB 285 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.
At 12:31 p.m. Senator Shapiro resumed the chair.
The chair laid out the subcommittee report on SB 523. Senator Averitt then moved adoption of the subcommittee report; there being no objection, it was so ordered. Senator Averitt moved that SB 523 do not pass but that CSSB 523 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.
The chair laid out the subcommittee report on SB 612. Senator Ogden then moved adoption of the subcommittee report; there being no objection, it was so ordered. Senator Ogden moved that SB 612 do not pass but that CSSB 612 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.
At 12:33 p.m. Senator Ogden assumed the chair.
As a matter of pending business, the chair laid out SB 8 and recognized the author, Senator Janek, on the bill. Senator Janek laid out pending Committee Amendment 1 by Senator West and moved adoption; without objection, the amendment was adopted. Senator Zaffirini requested unanimous consent to roll the amendment into the proposed committee substitute; without objection, it was so ordered. Senator Zaffirini then moved that the new committee substitute be adopted; without objection, it was so ordered. Senator Janek moved that SB 8 do not pass but that CSSB 8 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 3 absent.
There being no further business, at 12:35 p.m. Senator Ogden moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
Senator West requested unanimous consent to be shown voting aye on CSSB 161, CSSB 273, SB 285, CSSB 523, CSSB 612, and CSSB 8. There being no objection, it was so ordered.
