Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Education was held on Thursday, April 19, 2007, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 7:39 a.m.  The following business was transacted: 

 

The chair laid out the subcommittee report on SB 1749.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair left subcommittee report on SB 1749 pending. 

 

The chair laid out the subcommittee report on SJR 60.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair left subcommittee report on SJR 60 pending.

 

At 8:10 a.m. Senator Zaffirini assumed the chair. 

 

The chair laid out SB 1792 and recognized Senator Shapiro, in the absence of the author, to explain the bill.  Senator Shapiro sent up a committee substitute; the chair recognized Senator Shapiro to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair left SB 1792 pending.

 

At 8:12 a.m. Senator Shapiro resumed the chair. 

 

The chair laid out SB 817 and recognized Senator Zaffirini, in the absence of the author, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair left SB 817 pending.

 

At 8:21 a.m. Senator West assumed the chair. 

 

As a matter of pending business, the chair laid out SB 1788 and recognized the author, Senator Shapiro, to explain the bill.  Senator Shapiro withdrew the pending committee substitute to SB 1788.  Senator Shapiro sent up a committee substitute; the chair recognized Senator Shapiro to explain the difference between the committee substitute and the senate bill as filed.  The chair left SB 1788 pending.

 

At 8:24 a.m. Senator Shapiro assumed the chair. 

 

The chair laid out the subcommittee report on SB 1234.  Senator Zaffirini sent up a committee substitute; the chair recognized Senator Zaffirini to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list.

Senator Zaffirini moved adoption of the committee substitute; without objection, it was so ordered.  Senator Zaffirini moved that SB 1234 do not pass but that CSSB 1234 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 3 absent.  Senator Zaffirini moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

As a matter of pending business, the chair laid out SB 817.  Senator Van de Putte moved that SB 817 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 3 absent.  Senator Van de Putte moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

Senator Averitt requested unanimous consent to be shown voting aye on SB 817, CSSB 1792, SJR 60, CSSB 114, CSSB 1234, CSSB 1495, SB 1601, CSSB 1699, CSSB 1749, CSSB 1788; there being no objection, it was so ordered.
