Pursuant to suspension of Senate Rule 11.10, a public hearing of the Senate Committee on Education was held on Friday, April 27, 2007, at Senator Shapiro's Desk on the Senate floor.

The chair called the meeting to order at 4:13 p.m. There being a quorum present, the following business was transacted:
The clerk called the roll, a quorum was established.
At 4:13 p.m. Senator Janek assumed the chair.
Senator Shapiro moved to reconsider the vote by which the committee substitute to SB 101 passed out of the committee; there being no objection, the motion carried.
The chair laid out the committee substitute to SB 101. Senator Shapiro moved to reconsider the vote by which the committee substitute was adopted; there being no objection, the motion carried.
Senator Shapiro sent up Committee Amendment 1 to the proposed committee substitute, and moved adoption; without objection, the amendment was adopted.
Senator Shapiro sent up Committee Amendment 2 and moved adoption. The motion carried with a record vote of 8 ayes, 1 nay, 0 present not voting, and 0 absent.
Senator West sent up Committee Amendment 3 and moved adoption. The motion failed by a record vote of 3 ayes, 6 nays, 0 present not voting, and 0 absent.
Senator Shapiro moved to incorporate amendments into the committee substitute; there being objection, the clerk called the roll. The motion carried by a record vote of 7 ayes, 2 nays, 0 present not voting, and 0 absent. Senator Shapiro then moved that the new committee substitute be adopted; there being objection, the clerk called the roll. The motion carried by a record vote of 7 ayes, 2 nays, 0 present not voting, and 0 absent. Senator Shapiro moved that SB 101 do not pass but that CSSB 101 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 2 nays, 0 present not voting, and 0 absent.
There being no further business, at 4:47 p.m. Senator Shapiro moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
