Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Education was held on Tuesday, May 1, 2007, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 8:32 a.m. The following business was transacted:
At 8:32 a.m. Senator Zaffirini assumed the chair.
The chair laid out HB 1922 and recognized the Senate sponsor, Senator Shapiro, to explain the bill. Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered. The chair left HB 1922 pending.
At 8:39 a.m. Senator Shapiro resumed the chair.
The chair laid out HB 1270 and recognized the Senate sponsor, Senator Van de Putte, to explain the bill. Senator Van de Putte sent up a committee substitute; the chair recognized Senator Van de Putte to explain the difference between the committee substitute and the house bill as engrossed. Witnesses testifying and registering on the bill are shown on the attached list.
The clerk called the roll, a quorum was established.
The chair moved that the public testimony be closed; without objection, it was so ordered. Senator Janek moved adoption of the committee substitute; without objection, it was so ordered. Senator Janek moved that HB 1270 do not pass but that CSHB 1270 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 3 absent.
At 9:01 a.m. Senator Janek assumed the chair.
As a matter of pending business the chair laid out HB 1922. Senator Shapiro moved that HB 1922 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 3 absent.
At 9:02 a.m. Senator Shapiro resumed the chair.
The chair laid out the subcommittee report on SB 1045 by Senator Wentworth. Senator Janek moved adoption of the subcommittee report; there being no objection, it was so ordered. Senator Janek moved that SB 1045 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 1 nay, 0 present not voting, and 3 absent.
The chair laid out HB 208 and recognized the Senate sponsor, Senator Lucio, Jr., to explain the bill. Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered. The chair left HB 208 pending.

At 10:00 a.m. Senator Shapiro moved that the committee stand recessed subject to the call of the chair; without objection, it was so ordered.
Pursuant to the suspension of Senate Rules 11.10 and 11.18 at 5:47 p.m. the committee reconvened at Senator Shapiro’s Desk on the Senate Floor.

Senator Janek moved adoption of the minutes from the previous hearing held on April 24, 2007; without objection, it was so ordered.
As a matter of pending business the chair laid out HB 208 by Lucio. Senator Janek moved that HB 208 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 3 absent. Senator Janek moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.
As a matter of pending business the chair laid out SB 1016 by West. Senator Janek moved that SB 1016 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent.
There being no further business, at 5:50 p.m. Senator Shapiro moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
