Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Education was held on Tuesday, May 8, 2007, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 8:00 a.m.  The following business was transacted: 

 

The chair laid out HCR 159 and recognized the Senate sponsor, Senator Shapleigh, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair left the bill pending.

 

The chair laid out HB 273 and recognized the Senate sponsor, Senator Harris, to explain the bill.  Senator Janek sent up a committee substitute; the chair recognized Senator Harris to explain the difference between the committee substitute and the house bill as engrossed.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair left the bill pending.

Senator Janek moved adoption of the minutes from the previous hearings held on April 26, 2007, and April 27, 2007; without objection, it was so ordered. 

 

Senator Janek moved that HB 2176 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 4 absent.  Senator Janek moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

As a matter of pending business the chair laid out HB 273.  Senator Janek moved adoption of the committee substitute; without objection, it was so ordered.  Senator Janek moved that HB 273 do not pass but that CSHB 273 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 4 absent.  Senator Janek moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

The chair laid out the subcommittee report on SB 420 by Lucio.  Senator Janek moved that the subcommittee report be adopted, there being no objection, it was so ordered.  Senator Janek moved that SB 420 do not pass but that CSSB 420 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 4 absent. 

 

The chair laid out the subcommittee report on HB 125 sponsored by Senator Van de Putte.  Senator Janek moved that the subcommittee report be adopted, there being no objection, it was so ordered.  Senator Janek moved that HB 125 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 4 present not voting, and 0 absent.  Senator Van de Putte moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out the subcommittee report on HB 741 sponsored by Senator Zaffirini.  Senator Van de Putte moved that the subcommittee report be adopted, there being no objection, it was so ordered.  Senator Van de Putte moved that HB 741 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nays, 4 present not voting, and 0 absent.  Senator Van de Putte moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.
