Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Standing Senate Subcommittee on Higher Education was held on Tuesday, April 10, 2007, in the Capitol Extension Auditorium at Austin, Texas. The 24-hour posting rule was suspended so that the committee could take up and consider additional business and reconvene in E1.028 upon adjournment of the Senate.

The chair called the meeting to order at 7:00 a.m.  There being a quorum present, the following business was transacted: 

 

Senator West moved that the minutes of the April 4, 2007, hearing be approved. The motion was adopted by unanimous consent. 

 

The chair laid out SB 1446 and recognized the author, Senator Duncan, to explain the bill.

 

Names of witnesses who testified and registered for, against, or on the bill are on the attached list. The chair closed public testimony.

 

Senator West moved that SB 1446 be reported favorably to the full committee for its recommendation to the Senate that it do pass and be printed. There being 4 ayes and 0 nays,     SB 1446 was reported favorably. 

 

The chair laid out SB 1146 and recognized the author, Senator Shapiro, to explain the bill. Senator Averitt sent up a committee substitute for SB 1146 and moved its adoption. The motion was adopted by unanimous consent. The chair recognized Senator Shapiro to explain the difference between the committee substitute and the Senate bill as filed.

 

Names of witnesses who testified and registered for, against, or on the bill are on the attached list. The chair closed public testimony.

 

Senator Averitt moved that SB 1146 be reported to the full committee for its recommendation to the Senate that it do not pass, but that the committee substitute adopted in lieu thereof do pass and be printed. There being 4 ayes and 0 nays, the committee substitute for SB 1146 was reported favorably. 

 

The chair laid out SB 101 and recognized the author, Senator Shapiro, to explain the bill.

 

The chair laid out SB 128 and recognized the author, Senator West, to explain the bill.

 

The chair laid out SB 1569 and recognized the author, Senator Patrick, to explain the bill.

 

The chair laid out SB 1570 and recognized the author, Senator Patrick, to explain the bill.

 

The chair laid out SB 85 and recognized the author, Senator Hinojosa, to explain the bill.

 

The chair laid out SB 96 and recognized the author, Senator Ellis, to explain the bill.

 

The chair laid out SB 100 and recognized the author, Senator Shapiro, to explain the bill. Senator Averitt sent up a committee substitute for SB 100 and moved its adoption. The motion was adopted by unanimous consent. The chair recognized Senator Shapiro to explain the difference between the committee substitute and the Senate bill as filed.

 

The chair laid out SB 578 and recognized the author, Senator Ellis, to explain the bill.

 

The chair laid out SB 579 and recognized the author, Senator Ellis, to explain the bill.

 

The chair opened public testimony for SB 101, SB 128, SB 1569, and SB 1570. Names of witnesses who testified and registered for, against, or on these bills are on the attached list.

 

At 9:50 a.m. Senator Patrick assumed the chair.

 

10:20 a.m. Senator Patrick announced that the committee would stand in recess, subject to the call of the chair.

 

At 1 p.m. the committee reconvened and Senator Zaffirini resumed the chair.

 

The chair laid out SB 1131 and recognized the author, Senator Lucio, to explain the bill.

The chair laid out SB 1571 and recognized the author, Senator Patrick, to explain the bill.

 

Public testimony continued for SB 101, SB 128, SB 1569, SB 1570, and SB 1571. Names of witnesses who testified and registered for, against, or on these bills are on the attached list. The chair closed public testimony.

 

SB 101, SB 128, SB 1569, SB 1570 and SB 1571 were left pending.

 

The chair opened public testimony for SB 85, SB 96, SB 100, SB 578, SB 579, SB 1131. Names of witnesses who testified and registered for, against, or on these bills are on the attached list. The chair closed public testimony.

 

SB 85, SB 96, SB 100, SB 578, SB 579, SB 1131 were left pending.

 

There being no further business, at 3:29 p.m. Senator Patrick moved that the committee stand recessed, subject to the call of the chair.  The motion was adopted by unanimous consent.
