Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Finance was held on Thursday, May 3, 2007, in the Capitol Extension, Room E1.036, at Austin, Texas.

Senator Nelson, the acting chair, called the meeting to order at 8:30 a.m.  The following business was transacted: 

 

The chair laid out SB 1460 and recognized the author, Senator Seliger, to explain the bill.  Senator Nelson moved that SB 1460 be left pending to await public testimony; without objection, it was so ordered. 

 

The chair laid out SB 1477 and recognized the author, Senator Seliger, to explain the bill.  Senator Eltife sent up a committee substitute; the chair recognized Senator Seliger to explain the difference between the committee substitute and the senate bill as filed.  Senator Nelson moved that SB 1477 be left pending to await public testimony; without objection, it was so ordered. 

 

The chair laid out SB 257 and recognized the author, Senator Carona, to explain the bill.  Senator West sent up a committee substitute; the chair recognized Senator Carona to explain the difference between the committee substitute and the senate bill as filed.  Senator Nelson moved that SB 257 be left pending to await public testimony; without objection, it was so ordered. 

 

The chair laid out SB 1748 and recognized the author, Senator Nichols, to explain the bill.  Senator Nelson sent up a committee substitute; the chair recognized Senator Nichols to explain the difference between the committee substitute and the senate bill as filed.  Senator Nelson moved that SB 1748 be left pending to await public testimony; without objection, it was so ordered. 

 

The chair laid out SB 1936 and recognized the author, Senator Van de Putte, to explain the bill.  Senator Nelson sent up a committee substitute; the chair recognized Senator Van de Putte to explain the difference between the committee substitute and the senate bill as filed.  Senator Nelson moved that SB 1936 be left pending to await public testimony; without objection, it was so ordered.

The roll was called, and a quorum was established.

 

The chair laid out SB 1638, which had been left pending at a previous hearing.  Senator Williams sent up a committee substitute; the chair recognized Senator Williams to explain the difference between the committee substitute and the senate bill as filed.  Senator Williams moved adoption of the committee substitute; without objection, it was so ordered.  Senator Williams moved that SB 1638 do not pass but that CSSB 1638 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 7 absent. 

 

The chair laid out SB 49 and the adopted committee substitute, both of which had been left pending at a previous hearing.  Senator Lucio, Jr. moved that SB 49 do not pass but that CSSB 49 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 11 ayes, 0 nay, 0 present not voting, and 4 absent.  Senator Zaffirini and Senator Whitmire requested unanimous consent to be shown voting aye; without objection, it was so ordered.

 

The chair laid out SJR 17, which had been left pending at a previous hearing.  Senator Williams sent up a committee substitute; the chair recognized Senator Hegar to explain the difference between the committee substitute and the senate bill as filed.  Senator Williams moved adoption of the committee substitute; without objection, it was so ordered.  Senator Williams moved that SJR 17 do not pass but that CSSJR 17 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 6 absent.  Senator Zaffirini requested unanimous consent to be shown voting aye; without objection, it was so ordered.

 

The chair laid out SB 391, which had been left pending at a previous hearing.  Senator Williams sent up a committee substitute; the chair recognized Senator Hegar to explain the difference between the committee substitute and the senate bill as filed.  Senator Ogden moved that SB 391 be left pending; without objection, it was so ordered.
