Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Government Organization was held on Wednesday, April 11, 2007, in the Betty King Committee Hearing Room, 2E.20, at Austin, Texas.

The chair called the meeting to order at 8: 33 a.m. The following business was transacted:
The chair laid out SB 1761 and recognized the author, Senator Uresti, to explain the bill.
Witnesses testifying and/or registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered. Senator Ellis moved that SB 1761 be left pending; without objection, it was so ordered.
The chair laid out SB 861 and recognized the author, Senator Shapleigh, to explain the bill.
Senator Hegar sent up a committee substitute; the chair recognized Senator Shapleigh to explain the difference between the committee substitute and the senate bill as filed. Senator Hegar moved adoption of the committee substitute; without objection, it was so ordered. Witnesses testifying and/or registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered. Senator Ellis moved that SB 861 be left pending; without objection, it was so ordered.
At 8:40 a.m. Senator Hegar assumed the chair.
Senator Hegar laid out SB 1449 and recognized the author, Senator Ellis, to explain the bill.

The clerk called the roll at 8:48 a.m. A quorum was present.
Senator Ellis moved that SB 1449 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent. Senator Ellis moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.
At 8:50 a.m. Senator Ellis resumed the chair.

Senator Hegar moved that SB 1761 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent. Senator Hegar moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.
The chair called up SB 861.
Senator Hegar moved adoption of the committee substitute; without objection, it was so ordered. Senator Hegar moved that SB 861 do not pass but that CSSB 861 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent. Senator Hegar moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.
The chair laid out SB 1475 and recognized the author, Senator Jackson, to explain the bill.
Senator Jackson sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted. Witnesses testifying and/ or registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered. Senator Jackson requested unanimous consent to roll the amendment into a new committee substitute; without objection, it was so ordered. Senator Jackson then moved that the new committee substitute be adopted; without objection, it was so ordered. Senator Jackson moved that SB 1475 do not pass but that CSSB 1475 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent. Senator Jackson moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.
At 9: 00 a.m. Senator Ellis moved that the committee stand at ease until 9:15 a.m.; without objection, it was so ordered.
At 9: 21 a.m. the chair called the meeting to order.
The chair laid out SB 750 and recognized the author, Senator Deuell, to explain the bill.
Senator Whitmire sent up a committee substitute; the chair recognized Senator Deuell to explain the difference between the committee substitute and the senate bill as filed. Witnesses testifying and/or registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered.
Senator Whitmire asked to be shown voting aye on the following bills: SB 1761, SB 861, SB 1449, SB 1475, and SB 750.
Senator Brimer asked to be shown voting aye on the following bills: SB 1761, SB 861, SB 1449, SB 1475, and SB 750.
At 9:54 a.m. the chair moved that committee stand at ease subject to call of the chair; without objection, it was so ordered.
The chair suspended Senate Rules 11.10 and 11.18 on the Senate floor to continue the public hearing of the Senate Committee on Government Organization that was held on Wednesday, April 11, 2007. The continuation of the hearing was held in the Senate Chamber at Austin, Texas.
At 2:41 p.m. the committee reconvened.
The chair moved that the roll be called. A quorum being established, the following business was transacted.
The chair called up CSSB 72.
Senator Brimer moved that SB 72 do not pass but that CSSB 72 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent. Senator Hegar moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.
The chair called up SB 750.
Senator Whitmire moved adoption of the committee substitute; without objection, it was so ordered. Senator Whitmire moved that SB 750 do not pass but that CSSB 750 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.
At 2:43 p.m. the chair moved that the committee stand recessed subject to call of the chair; without objection, it was so ordered.
