Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Criminal Justice was held on Tuesday, March 13, 2007, in the Capitol Extension, Room E1.016, at Austin, Texas.

The chair called the meeting to order at 1:43 p.m.  There being a quorum present, the following business was transacted: 

 

The posting rule, Senate Rule 11.18, was suspended to hear the following bill: SB 1921.

The chair laid out SB 1921 and recognized the author, Senator Harris, to explain the bill.  No persons registered or testified on SB 1921. 

 

Senator Seliger moved that SB 1921 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent. 

 

The chair laid out SB 6 and recognized the author, Senator Zaffirini, to explain the bill. 

 

Senator Seliger sent up a committee substitute; the chair recognized Senator Zaffirini to explain the difference between the committee substitute and the senate bill as filed.  Senator Deuell moved adoption of the committee substitute; without objection, it was so ordered.  Witnesses registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Deuell moved that SB 6 do not pass but that CSSB 6 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent. 

 

Senator Carona moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The posting rule, Senate Rule 11.18, was suspended to hear the following bill: HB 8. 

The chair laid out HB 8 and recognized the Senate sponsor, Senator Deuell, to explain the bill.

 

Senator Deuell sent up a committee substitute; the chair recognized Senator Deuell to explain the difference between the committee substitute and the house bill as engrossed.  Senator Deuell moved adoption of the committee substitute; without objection, it was so ordered.   

 

The chair laid out SB 5 and recognized the author, Senator Deuell, to explain the bill.

 

Senator Deuell sent up a committee substitute; the chair recognized Senator Deuell to explain the difference between the committee substitute and the senate bill as filed.  Senator Deuell moved adoption of the committee substitute; without objection, it was so ordered.   

 

Witnesses testifying and registering on HB 8 and SB 5 are shown on the attached list. 

The chair moved that the public testimony be closed; without objection, it was so ordered.     

 

Senator Deuell moved that SB 5 do not pass but that CSSB 5 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 1 nay, 1 present not voting, and 0 absent. 

 

Senator Deuell moved that HB 8 do not pass but that CSHB 8 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 1 nay, 1 present not voting, and 0 absent. 

 

There being no further business, at 7:20 p.m. Senator Whitmire moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
