Pursuant to suspension of Senate Rule 11.18, a public hearing of the Senate Committee on Criminal Justice was held on Wednesday, May 9, 2007, at Senator Whitmire's Desk on the Senate Floor in Austin, Texas.

Senator Seliger called the meeting to order at 3:21 p.m.  There being a quorum present, the following business was transacted: 

 

Senator Whitmire requested to be shown voting with the chair on all votes.

 

As a matter of pending business, the chair laid out HB 44.  Senator Ellis moved that HB 44 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Ellis moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

As a matter of pending business, the chair laid out HB 198.  Senator Ellis moved that HB 198 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Ellis moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

As a matter of pending business, the chair laid out HB 1355.  Senator Ellis sent up a committee substitute; the chair recognized Senator Shapleigh to explain the difference between the committee substitute and the house bill as engrossed.  Senator Ellis moved adoption of the committee substitute; without objection, it was so ordered.  Senator Ellis moved that HB 1355 do not pass but that CSHB 1355 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

As a matter of pending business, the chair laid out HB 425.  Senator Hinojosa moved that HB 425 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Hinojosa moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

As a matter of pending business, the chair laid out HB 530.  Senator Seliger withdrew Committee Amendment 2.  Senator Seliger sent up Committee Amendment 3 and moved adoption; without objection, the amendment was adopted.  Senator Seliger sent up Committee Amendment 4 and moved adoption; without objection, the amendment was adopted.  Senator Seliger requested unanimous consent to roll the amendments into the committee substitute; without objection, it was so ordered.  Senator Seliger then moved that the committee substitute be adopted; without objection, it was so ordered.  Senator Seliger moved that HB 530 do not pass but that CSHB 530 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Seliger moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.
