Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Criminal Justice was held on Monday, May 21, 2007, at Senator Whitmire's Desk on the Senate Floor in Austin, Texas.

The chair called the meeting to order at 3:03 p.m.  There being a quorum present, the following business was transacted: 

 

Senator Hegar requested that the Committee reconsider the vote for HB 2300.  There being no objection, Senator Hegar withdrew the previously adopted substitute for HB 2300 and sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted.  Senator Hegar moved that HB 2300, as amended, be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent. 

 

At 3:04 p.m. Senator Hinojosa assumed the chair. 

 

The chair laid out HB 946 and recognized the Senate sponsor, Senator Whitmire, to explain the bill.  Senator Whitmire moved that HB 946 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent. 

 

At 3:05 p.m. Senator Whitmire resumed the chair. 

 

On May 21, 2007, Senator Whitmire suspended Senate Rules 11.10 and 11.18 on the Senate Floor to take up and consider HB 3584 and HCR 96. 

 

The chair laid out HB 3584 and recognized the Senate sponsor, Senator Van de Putte, to explain the bill.  Senator Hinojosa moved that HB 3584 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent. 

 

At 3:06 p.m. Senator Hinojosa assumed the chair. 

 

The chair laid out HCR 96 and recognized Senator Whitmire, in the absence of the Senate sponsor, to explain the bill.  Senator Whitmire moved that HCR 96 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent. 

 

At 3:07 p.m. Senator Whitmire resumed the chair. 

 

There being no further business, at 3:07 p.m. Senator Whitmire moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
