CONCURRENT RESOLUTION
         WHEREAS, Texas water districts play a crucial role in
  protecting water resources and the public health, enabling economic
  growth, and providing a high quality of life for the residents who
  live within their boundaries; poorly performing districts,
  however, undermine communities and threaten the legitimacy of
  public policy; and
         WHEREAS, Following 18 months of review and audits by agencies
  of this state and by the Bexar Metropolitan Water District
  Oversight Committee, the legislature finds that certain officials
  of the district have engaged in unethical conduct and
  unprofessional management practices, that disagreements regarding
  the district's jurisdiction and the jurisdiction of other entities
  inside the district and distrust between management personnel and
  the board have prevented the district from improving services for
  existing customers and meeting the water supply needs of the
  growing population within the district's service area, that the
  district has a history of noncompliance with regulations, that the
  board has engaged in mismanagement of the district, allowing for
  financial improprieties, and that the district has provided
  unreliable service to the degree that the quality of life of the
  district's customers is impaired and the prospects of economic
  growth within the district are diminished; and
         WHEREAS, Water districts are accountable to the state for the
  proper performance of their powers and duties, and in light of these
  findings about the Bexar Metropolitan Water District, it is
  appropriate that the district undergo regular and thorough
  appraisals in order to ensure improvement in its overall
  operations; now, therefore, be it
         RESOLVED, That the 81st Legislature of the State of Texas,
  1st Called Session, hereby direct the State Auditor's Office to
  conduct an annual audit of the Bexar Metropolitan Water District
  for five years beginning in 2009; and, be it further
         RESOLVED, That the scope of the audit be determined by the
  state auditor, subject to approval by the Legislative Audit
  Committee, and that it be based on a risk assessment.
