	Amend CSHB 339 (house committee printing) as follows:                        
	(1)  On page 6, line 23, between "device" and the period, 
insert:            

unless the device is used to make a communication:                     
			(A)  with hands-free operation of a hands-free 
device; or           
			(B)  in case of an emergency                                          
	(2)  On page 7, line 8, between "device" and the period, 
insert:             

unless the wireless communications device is used:                     
			(A)  with a hands-free device; or                                     
			(B)  in case of an emergency                                          
	(3)  On page 7, strike lines 17-19 and substitute:                             
	(f)  In this section:                                                   
		(1)  "Hands-free device" means speakerphone capability 
or a telephone attachment or other piece of equipment, regardless 
of whether permanently installed in the motor vehicle, that allows 
use of the wireless communication device without use of either of 
the operator's hands.
		(2)  "Wireless communication device" means a handheld 
or hands-free device that uses commercial mobile service, as 
defined by 47 U.S.C. Section 332.
	(4)  Add the following appropriately numbered SECTION to the 
bill and renumber subsequent SECTIONS of the bill accordingly:
	SECTION ____.  Section 543.204, Transportation Code, is 
amended by adding Subsection (a-1) to read as follows:
	(a-1)  A justice of the peace or municipal judge may not 
submit a written record of a conviction under Section 545.424.
