Amend CSHB 1357 (Senate committee report) as follows:                        
	(1)  In SECTION 2 of the bill, strike added Section 
843.002(9-a) and substitute the following:
		(9-a)  "Freestanding emergency medical care facility" 
means a facility licensed under Chapter 254, Health and Safety 
Code.  A health care plan is not obligated to pay a facility fee to a 
licensed free standing emergency care facility that is operating 
less than 24 hours a day, seven days a week.
	(2)  In SECTION 5 of the bill, in amended Section 1301.155, 
Insurance Code (page 7, between lines 51 and 52), insert Section 
1301.155(c), Insurance Code, as follows:
	(c)  An insurer is not obligated to pay a facility fee to a 
licensed free standing emergency care facility that is operating 
less than 24 hours a day, seven days a week.
