Amend the Thibaut amendment to CSHB 4586 (page 3, prefiled 
amendment packet) as follows:
	(1)  On lines 4 and 5, strike "a new appropriately numbered 
section to read as follows" and substitute "the following 
appropriately numbered sections and renumber the subsequent 
sections of the bill accordingly".
	(2)  On line 9, strike "$68,268,044" and substitute 
"$66,268,044".           
	(3)  Following line 17, add the following:                                     
	SECTION ____.  TEXAS COMMISSION ON ENVIRONMENTAL QUALITY.  
In addition to amounts previously appropriated for the state fiscal 
biennium ending August 31, 2009, the amount of $2,000,000 is 
appropriated out of the general revenue fund to the Texas 
Commission on Environmental Quality for the two-year period 
beginning on the effective date of this Act for conducting 
hazardous substance removal and disposal activities at Ballard 
Pits, a state superfund site in Nueces County.
