	Amend Floor Amendment No. 1 (floor substitute) by 
Representative Branch to CSSB 175 as follows:
	(1)  In the recital to SECTION 1 of the bill (page 1, lines 4 
and 5), strike "Subsections (a-1), (a-2), and (g)" and substitute 
"Subsections (a-1), (a-2), (a-3), and (g)".
	(2)  In SECTION 1 of the bill, at the beginning of added 
Section 51.803(a-1), Education Code (page 2, lines 5-6), strike 
"Beginning with admissions for the 2010-2011 academic year" and 
substitute "Beginning with admissions for the 2010-2011 academic 
year and subject to Subsection (a-3)".
	(3)  In SECTION 1 of the bill, immediately following added 
Section 51.803(a-2), Education Code (page 4, between lines 2 and 
3), insert the following:
	(a-3)  A general academic teaching institution may not begin 
to offer admission to first-time resident undergraduate students 
under Subsection (a-1) unless the change in admission policy is 
approved by a majority of the students of the institution voting in 
a student referendum held at the institution for that purpose.  The 
institution must conduct the student referendum in the fall 
semester of the academic year before the first academic year for 
which the institution intends to offer admission under Subsection 
(a-1).  At the referendum, the ballot shall be prepared to permit 
students to vote for or against the proposition "Permitting (insert 
name of institution) to limit the admission of Texas residents who 
graduate in the top 10 percent of their high school graduating class 
to 60 percent of the entering freshman class of Texas residents."  
If the number of students voting for the proposition is less than a 
majority of the students voting in the referendum, the institution 
may not offer admission under Subsection (a-1) for the following 
academic year.  An institution at which the students vote to approve 
the proposition under this subsection is not required to conduct 
another referendum to continue to offer admission under Subsection 
(a-1).
