Amend Floor Amendment No. 3 by Lucio, to CSSB 298 as follows:                
	(1)  At page 1, line 5 in proposed Article 65.02, Code of 
Criminal Procedure, after "CHECKPOINTS.", strike "A" and insert 
"(a)  Except as provided by Subsection (b), a".
	(2)  In proposed Article 65.02, Code of Criminal Procedure, 
add a new Subsection (b) to read as follows:
	(b)  The Department of Public Safety may not operate a 
temporary checkpoint in a county with a population of less than 
250,000.
