AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

S.B. 267, enacted during the 80th Legislature, Regular Session, 2007, established attendance requirements for the board of directors of the Lynn County Hospital District and provided for legal removal of the board members who do not comply.  The intent of the bill was to require the members to attend half of the regularly scheduled board meetings.  However, a drafting error placed the attendance threshold at three-fourths.

 

H.B. 118 requires members of the board of directors of the Lynn County Hospital District to attend half of the regularly scheduled meetings.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 4A(a), Chapter 66, Acts of the 60th Legislature, Regular Session, 1967, to provide that it is a ground for removal from the board of directors of the Lynn County Hospital District (board) that a member is absent from more than half, rather than three-fourths, of the regularly scheduled board meetings that the member is eligible to attend during a calendar year without an excuse approved by a majority vote of the board.

 

SECTION 2.  Amends Section 1054.0565(a), Special District Local Laws Code, as effective September 1, 2009, to make a conforming change.

 

SECTION 3.  (a)  Provides that Section 1 of this Act takes effect only if the Act of the 81st Legislature, Regular Session, 2009, relating to nonsubstantive additions to and corrections in existing codes does not become law.

 

(b)  Provides that Section 2 of this Act takes effect only if the Act of the 81st Legislature, Regular Session, 2009, relating to nonsubstantive additions to and corrections in existing codes becomes law.

 

SECTION 4.  Effective date: September 1, 2009.
