BACKGROUND AND PURPOSE
Many police officers are currently eligible to perform commercial motor vehicle safety inspections, but very few sheriffs and sheriff's deputies are. Under current law, only sheriffs and deputies in a county with a population of 2.2 million or more (Dallas and Harris County) are eligible to perform the same commercial motor vehicle safety inspections that police officers across the state are eligible to perform.
H.B. 207 would expand the number of counties whose sheriffs and sheriff's deputies would be eligible to perform these safety inspections from 2 to 18, allowing the sheriffs and deputies of any county with a population over 250,000 to perform these inspections.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
SECTION 1. Amends Section 644.101(c) Transportation Code, by reducing the population eligibility threshold for counties eligible to apply for commercial motor vehicle safety certification from 2.2 million to 250,000.
SECTION 2. Effective Date

September 1, 2009.
