AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The Goliad County Groundwater Conservation District was created in 2001, by authority of H.B. 3651, Acts of the 77th Legislature, Regular Session, 2001.  Goliad County voters approved the district on November 6, 2001. 

 

H.B. 753 changes the biennial uniform election date for district directors from May to November.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 12, Chapter 1359 (H.B. 3651), Acts of the 77th Legislature, Regular Session, 2001, as follows:

 

Sec. 12.  ELECTION OF REGULAR DIRECTORS.  Requires that, beginning in the second year following the confirmation election under Section 8 of this Act, an election be held on the first uniform election date in November, rather than May, every two years to elect the appropriate number of directors to the board.

 

SECTION 2.  (a) Provides that all governmental and proprietary actions of the Goliad County Groundwater Conservation District taken before the effective date of this Act are validated, ratified, and confirmed in all respects as if the actions had been taken as authorized by law.

 

(b) Provides that this section does not apply to any matter that on the effective date of this Act is involved in litigation if the litigation ultimately results in the matter being held invalid by a final court judgment or has been held invalid by a final court judgment.

 

SECTION 3. Effective date: upon passage or September 1, 2009.
