BACKGROUND AND PURPOSE

 

The Goliad County Groundwater Conservation District was created in 2001 by authority of H.B. 3651, Acts of the 77th Legislature, Regular Session, 2001. Goliad County voters approved the district on November 6, 2001.

 

H.B. 753 changes the biennial uniform election date for district directors to November, as

requested by the district.

 

RULEMAKING AUTHORITY

 

It is the Committee’s opinion that the bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1. Amends Section 12, Chapter 1359 (H.B. 3651), Acts of the 77th Legislature, Regular Session, 2001, as follows:

 

Sec. 12. ELECTION OF REGULAR DIRECTORS.  Provides that the date for electing the directors of the Goliad County Groundwater Conservation District to the first uniform election date in November every two years rather than the first uniform election date in May every two years.

 

SECTION 2.   Provides that all governmental and proprietary actions of the district taken before the effective date of the bill are validated, ratified, and confirmed in all respects as if the actions had been taken as authorized by law. The bill specifies that the provisions of the bill do not apply to any matter that on the effective date of the bill is involved in litigation if the litigation ultimately results in the matter being held invalid by a final court judgment or has, on the effective date, been held invalid by a final court judgment.

 

SECTION 3. Provides the effective date of this Act.

 

EFFECTIVE DATE

 

This Act takes effect immediately if it receives a vote of two-thirds of all members elected to each house, as provided by Section 39, Article III, Texas Constitution.  If this Act does not receive the vote necessary for immediate effect, the effective date is September 1, 2009.
