BACKGROUND AND PURPOSE

 

The Brewster County Groundwater Conservation District ("the district") has identified water wells as an important part of their long-term water planning. Current law does not allow the district to regulate or supervise water wells in their district and the district has identified this as important need to preserve groundwater for future use. Empowering the district to protect and preserve water on the local level will help communities fulfill their long-term needs.

 

H.B. 811 will allow the district to regulate and supervise water wells in their district.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1. Amends Section 5, Chapter 1291, Acts of the 77th Legislature, Regular Session, 2001, by adding subsection (d), as follows: 

 

Subsection (d). Provides that Section 36.121, Water Code, does not apply to the district.

 

SECTION 2. Provides the effective date of this Act.

 

EFFECTIVE DATE

 

This Act takes effect September 1, 2009.
