BACKGROUND AND PURPOSE

 

Under current law, cities are authorized to hold continuation elections for crime control and prevention districts. Five-year continuations expire on the fifth anniversary of the most recent continuation election. Continuations of other authorized periods expire "at the end of the period for which it was continued." As a result of the reduction in uniform election dates, continuation elections for crime control and prevention districts must be held prior to the expiration of the full continuation period. With the continuation provisions of H.B. 817, taxes may continue to be collected for the limited purpose of retiring outstanding short-term and long-term liabilities of the district.

 

H.B. 817 provides for an extension of the continuation period of a crime control and prevention district in very limited circumstances.

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

 

H.B. 817 amends the Local Government Code to extend the dissolution date of a crime control and prevention district that has not held a continuation or dissolution referendum from the fifth anniversary of the date the district began to levy taxes for district purposes to the first uniform election date that occurs after such fifth anniversary. The bill extends the dissolution date of a district that has held a continuation or dissolution referendum from the fifth anniversary of the date of the most recent continuation or dissolution referendum to the first uniform election date that occurs after such fifth anniversary.

EFFECTIVE DATE

 

On passage, or, if the act does not receive the necessary vote, the act takes effect September 1, 2009.
