BACKGROUND AND PURPOSE

 

The Texas Incentive and Productivity Commission (TIPC) was created in 1989 to administer programs that reduced state agencies' operating costs through the improvement of productivity.  At the height of its operation TIPC had six fulltime employees, including a director, and operated with an annual budget of $211,233.  In 2004 the State Council on Competitive Government released a report with the finding that small and mid sized agencies rarely participated in TIPC programs.  In the absence of meaningful agency participation in the programs, the Council recommended that individual agencies be responsible for implementing their own employee suggestion program on a voluntary basis beginning September 1, 2004 under guidelines developed by the Council.  Following the Council's 2004 report TIPC ceased operations during fiscal year 2005.  During the 79th Session in 2005 the Legislature discontinued funding for TIPC upon the recommendation of the Legislative Budget Board.  In 2007 80th Legislature did not appropriate any funds for the TIPC for the 2008-2009 fiscal biennium.  Although authorized by law, the TIPC no longer exists as a functioning state agency.  Nor do any other state agencies participate in the state employee incentive program administered by the Commission. 

 

H.B. 874 abolishes the Texas Incentive and Productivity Commission and the state employee incentive program administered by the Commission.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

H.B. 874 repeals Subchapters A and B, Chapter 2108, Government Code, to abolish the Texas

Incentive and Productivity Commission (TIPC) and the state employee incentive program. The

bill eliminates all TIPC employee positions and specifies that any memorandum of

understanding or interagency contract entered into between the TIPC and another state agency

expires on the effective date of the bill.

 

H.B. 874 expressly repeals the following statutes:

 

Subchapters A and B, Chapter 2108, Government Code, authorizing the Texas Incentive and Productivity Commission and the state employee incentive program.

 

Section 201.0192, Agriculture Code, requiring that employees of the State Soil and Water Conservation Board be provided with information and training regarding the state employee incentive program.

 

Section 61.0281, Education Code, requiring that employees of the Texas Higher Education Coordinating Board be provided with information and training regarding the state employee incentive program.

 

Section 12.113, Finance Code, requiring that employees of the Texas Department of Banking be provided with information and training regarding the state employee incentive program.

 

Section 13.015, Finance Code, requiring that employees of the Department of Savings and Mortgage Lending be provided with information and training regarding the state employee incentive program.

 

Section 14.067, Finance Code, requiring that employees of the Office of Consumer Credit Commissioner be provided with information and training regarding the state employee incentive program.

EFFECTIVE DATE

 

On passage, or, if the act does not receive the necessary vote, the act takes effect September 1, 2009.
