AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
H.B. 888 amends current law relating to the detention and examination of certain persons accepted for a preliminary mental health examination.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 573.021(b), Health and Safety Code, to authorize the person if the 48-hour period ends on a Saturday, Sunday, legal holiday, or before 4 p.m., rather than 12 p.m., on the first succeeding business day, to be detained until four p.m. rather than 12 p.m. on the first succeeding business day.
SECTION 2. Makes application of this Act prospective.
SECTION 3. Effective date: upon passage or September 1, 2009.
