BACKGROUND AND PURPOSE

 

Current law requires all nursing homes and related institutions to post on their premises information regarding the compliance status of the institution. The notice must be onsite and readily available to residents, employees, and visitors. The Department of Aging and Disability Services voluntarily posts this information on the department's website.

 

H.B. 1081 requires the Department of Aging and Disability Services to post and update compliance history information regarding nursing homes and related institutions on the department's website.

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

 

H.B. 1081 amends the Health and Safety Code to require the Department of Aging and Disability Services to post detailed compliance information regarding each institution licensed by the department, including information about the rights of residents and any citation for a violation of those rights by an institution and a statement of an institution's record of compliance on the department's website. The bill requires the department to update the website once a month to provide the most current compliance information regarding each institution.
