H.B. 1083 amends current law relating to mediation orders in certain arbitration proceedings.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 154.021, Civil Practice and Remedies Code, by adding Subsection (c), as follows:
(c) Prohibits a court, except as provided by agreement of the parties, from ordering mediation in an action that is subject to the Federal Arbitration Act (9 U.S.C. Sections 1-16).
SECTION 2. Makes application of this Act prospective.
SECTION 3. Effective date: upon passage or September 1, 2009.
