AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Texas State Highway 289 runs north-south, beginning in downtown Dallas and terminating west of Sherman near the Texas-Oklahoma border.  The highway is known for most of its length as Preston Road due to its proximity to the primary portion of the original Preston Trail.

 

Preston Trail was the north Texas portion of an ancient Indian trail extending from Mexico through central Texas all the way to what is now St. Louis, Missouri, and on to Ohio where the Shawnee Indians lived.  Preston Trail became part of the first official Texas military road in 1839.

 

H.B. 1272 would designate State Highway 289 as the Preston Trail Highway.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter B, Chapter 225, Transportation Code, by adding Section 225.0402, as follows:

 

Sec.  225.0402.  PRESTON TRAIL HIGHWAY.  (a)  Provides that State Highway 289 is designated as the Preston Trail Highway.

 

(b)  Requires the Texas Department of Transportation (TxDOT), subject to Section 225.021(c) (relating to conditions requiring TxDOT to design, construct, or erect a marker), to design and construct markers indicating the highway number, the designation as the Preston Trail Highway, and any other appropriate information.  Requires TxDOT to erect a marker at each end of the highway and at appropriate intermediate sites along the highway.

 

SECTION 2.  Effective date:  upon passage or September 1, 2009.
