AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Current legislation authorizes members of the board of directors of a defense base development authority to participate by conference call when the meeting is chaired by a president or vice president. Port San Antonio and other defense base development authorities have chairmen and vice chairmen as opposed to presidents and vice presidents. This bill seeks to correct this reference.
H.B. 1345 amends current law relating to titles by which certain officers of a defense base development authority may be known.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 379B.007, Local Government Code, by amending Subsection (f) and adding Subsection (f-1), as follows:
(f) Requires the members of the board of directors of the defense base development authority established under this chapter to elect from its membership a president and vice president or a chairperson and vice chairperson and a secretary and a treasurer. Makes nonsubstantive changes.
(f-1) Creates this subsection from existing text.
SECTION 2. Amends Section 379B.0085(a), Local Government Code, to authorize any number of the other members of a board or board committee, as an exception to Chapter 551 (Open Meetings), Government Code, and other law, if the chairperson, president, vice chairperson, or vice president of a board, or chairperson or vice chairperson of board committee, is physically present at a meeting of the board or committee, to attend the meeting by use of telephone conference call, video conference call, or other similar telecommunication device.
SECTION 3. Effective date: September 1, 2009.
