AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The Texas Board of Architectural Examiners is charged with the regulation of interior designers.  Current law allows only architects and licensed or registered interior designers to use the title "interior designer," creating issues with persons who practice interior design but have either chosen not to be registered or who do not meet educational or other requirements to be eligible for registration.

 

H.B. 1484 prohibits a person who is not licensed or registered as an interior designer from using the title "licensed interior designer" or "registered interior designer."

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 1053.002(a), Occupations Code, to provide that this chapter does not apply to a person who does not use a business or professional title that uses the phrase "registered interior designer." Makes nonsubstantive changes.

 

SECTION 2.  Amends Section 1053.151, Occupations Code, as follows:

 

Sec. 1053.151.  REGISTRATION REQUIRED.  Prohibits a person other than an interior designer from representing that the person is a "registered interior designer" by using that title or by using words that imply that the person is a registered interior designer.  Deletes existing text prohibiting a person other than an interior designer from representing that the person is an "interior designer" by using that title, or representing, by using the term "interior design," a service the person offers or performs.  Makes nonsubstantive changes.

 

SECTION 3.  Effective date:  upon passage or September 1, 2009.
