BACKGROUND AND PURPOSE

 

The Anderson County Underground Water Conservation District was created with the enactment of S.B. 1518, Acts of the 70th Legislature, Regular Session, 1987. The law initially provided that

elections for members of the board of directors of the district would be held in odd-numbered years. Through other legislation, elections were switched to even-numbered years. The Texas Legislative Council alerted the district that they were not in compliance with current law and needed to correct the error through legislation.

 

H.B. 1683 corrects that error and ensures that elections for directors of the district are held in compliance with Texas law.

 

RULEMAKING AUTHORITY

 

It is the Committee’s opinion that the bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1. Amends Section 9, Chapter 992, Acts of the 70th Legislature, Regular Session, 1987 by changing Section 9 as follows:

 

Sec. 9. ELECTION OF DIRECTORS.  Provides that an election of members of the board of directors of Anderson County Underground Water Conservation District is held on the uniform election date in May every two years rather than the third Saturday in May every two years.

 

SECTION 2.   Provides that all governmental and proprietary actions of the district taken before the effective date of the bill are validated, ratified, and confirmed in all respects as if the actions had been taken as authorized by law. The bill specifies that the provisions of the bill do not apply to any matter that on the effective date of the bill is involved in litigation if the litigation ultimately results in the matter being held invalid by a final court judgment or has, on the effective date, been held invalid by a final court judgment.

 

SECTION 3. Provides the effective date of this Act.

 

EFFECTIVE DATE

 

This Act takes effect immediately if it receives a vote of two-thirds of all members elected to each house, as provided by Section 39, Article III, Texas Constitution.  If this Act does not receive the vote necessary for immediate effect, the effective date is September 1, 2009.
