BACKGROUND AND PURPOSE

 

Currently, the Wharton County Commissioners Court performs the duties of promoting improved drainage and flood control in Wharton County.  An ongoing program of improved drainage and flood control is important as the population of the county grows. 

 

H.B. 1782 establishes the Wharton County Drainage District, giving the district the powers and duties of a drainage district.

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

 

H.B. 1782 amends the Special District Local Laws Code to set forth standard language for the creation of the Wharton County Drainage District.  The bill sets forth general provisions for the nature of the district, the district's public benefit and purpose, and initial district territory; the number of members of the board; and the powers and duties of the district, including the duty to hold an election to confirm the creation of the district.

 

H.B. 1782 provides for the expiration of these provisions if the creation of the district is not confirmed at a confirmation election before September 1, 2011.

 

H.B. 1782 defines the terms "board," "director," and "district."

September 1, 2009.
