AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Under current law, the Public Utility Commission of Texas (PUC) is required to take enforcement action against an electric utility or a transmission and distribution utility if any feeder with 10 or more customers appears on the utility's list of worst 10 percent performing feeders for any two consecutive years or has had a system-average interruption duration index of system-average interruption frequency index average that is more than 300 percent greater than the system average of all feeders during any two year period.

 

This legislation removes the "worst 10 percent performing feeders" criteria, but retains the 300 percent system-average interruption duration index or system-average interruption frequency index criteria.  This bill amends current law relating to electric service reliability measures.

 

H.B. 2052 amends current law relating to electric service reliability measures.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 38.005(b), Utilities Code, as follows:

 

(b)  Authorizes the Public Utility Commission of Texas (PUC) to take appropriate enforcement action under this section, including action against a utility, if any of the utility's feeders with 10 or more customers has had a SAIDI or SAIFI average that is more than 300 percent greater than the system average of all feeders during any two-year period, beginning in the year 2000, rather than requires PUC to take appropriate action under this section, including but not limited to action against a utility if any feeder with 10 or more customers appears on the utility's list of worst 10 percent performing feeders for any two consecutive years or has had a SAIDI or SAIFI average that is more than 300 percent greater than the system average of all feeders during any two-year period, beginning in the year 2000.  Requires PUC, in determining the appropriate enforcement action, to consider the feeder's operating and maintenance history, the cause of each interruption in the feeder's service, any action taken by a utility to address the feeder's performance, the estimated cost and benefit of remediating a feeder's performance, and any other relevant factor as determined by PUC.

 

SECTION 2.  Effective date:  upon passage or September 1, 2009.
